For paperwork handled after a death — separate from your vault subscription

1. When These Terms Apply

These Estate Services Terms apply when you ask SafeNominee to help with the paperwork that follows a death — for example obtaining certificates, claiming bank accounts, insurance policies or investments, transferring property, or closing tax and business affairs. They are separate from, and additional to, the SafeNominee Terms of Service and Privacy Policy, which continue to apply. Your vault subscription does not include Estate Services; each case is approved and paid for separately. You accept these Terms when you approve a case. If you do not agree with them, do not approve the case.

2. Who Carries Out the Work

2.1 Independent professionals

Most cases are carried out by independent professionals — chartered accountants, lawyers and firms — who are verified and monitored by SafeNominee but are not employees of Bitlooper LLP. For those cases, the professional is responsible for their own advice, conduct, competence and results. Bitlooper LLP operates the platform, verifies and monitors professionals, assigns and coordinates the case, and holds and settles the fee. It does not itself provide legal, tax or financial advice, and a claim about the professional services lies against that professional.

2.2 Cases handled by SafeNominee's own team

Some cases are carried out by SafeNominee's own estate team. Where that is so, Bitlooper LLP is the service provider for that case and carries a provider's responsibilities for the work — it does not rely on the intermediary position described in 2.1. You will be told, before you approve any work, whether your case is assigned to an independent professional or to SafeNominee's own team.

2.3 No guaranteed outcome

Neither SafeNominee nor any assigned professional guarantees a particular outcome, recovery of any asset, inheritance, entitlement, or completion within a particular time. Institutions, courts and government offices set their own requirements and timelines, which are outside anyone's control.

3. Money: How It Is Collected, Held and Released

3.1 The service fee is held before it is paid out

The consultation/service fee for a case is collected when you approve the work, and is NOT paid to the professional at that point. It is held by SafeNominee pending release. It is released to the professional when you confirm the work is complete. Nothing releases it on a timer. If you do not respond, it stays held and we will contact you. If you tell us there is a problem instead of confirming, we review the case and decide whether to release the fee, refund you, or split it.

3.2 Milestone payments are not held

A case may need two further kinds of payment during the work. They are raised as separate requests, shown to you before you approve them, and they are NOT treated the same way. Your professional's own fee for extra work is held exactly as in 3.1 — released only when you confirm the work is done. Government and other real costs your professional pays on your behalf are paid straight through to them and are not held. That money is going to a government office, not being earned, so holding it would only stop the work.

3.3 Government and third-party costs

Government fees, stamp duty, and similar actual third-party charges are pass-throughs. They are shown separately, are not SafeNominee's revenue, and are payable in full.

3.4 What SafeNominee earns

SafeNominee retains a platform commission out of the service fee. Where a partner referred you to SafeNominee, a referral share is also paid out of that same fee. Neither is charged on top of the amount shown to you: the total payable is displayed in full before you approve. Milestone payments carry no platform commission. GST is charged and remitted as applicable, and an invoice is issued.

3.5 How payments are processed

Payments are processed through an RBI-authorised payment gateway. Amounts held pending release under 3.1 are held in accordance with applicable law, including the Reserve Bank of India's requirements for payment aggregators.

4. If You Are Not Satisfied

4.1 Raising a problem before release

Before the fee is released you may report a problem with the work. The case is then marked as disputed and the money stays held while SafeNominee reviews it. Following that review SafeNominee may release the fee to the professional, or refund you and issue a credit note reversing the GST charged.

4.2 Reassignment

While no money has been released, SafeNominee may reassign a case to another professional — for example if the assigned professional declines, becomes unavailable, or is removed from the platform. Once a fee has been released or a milestone has been paid, a case cannot be reassigned and is handled as a dispute instead.

4.3 Limits of SafeNominee's role in a dispute

For cases handled by an independent professional, SafeNominee is not obliged to adjudicate every disagreement between you and that professional. It may instead pause payouts, facilitate a resolution, refund you under 4.1, or remove the professional from the platform. Nothing in these Terms limits any right you have to pursue the professional directly, or to approach a consumer forum or the professional's regulatory body. For cases handled by SafeNominee's own team, complaints are handled by SafeNominee as the provider.

4.4 Ratings and complaints

You may rate a completed case and raise a complaint about it. SafeNominee uses ratings and complaints to monitor the marketplace, including suspending or removing professionals.

5. Your Responsibilities

When you approve a case, you confirm that:

  • You are entitled to instruct work in relation to the estate concerned
  • You are authorised to share the documents and information you upload for the case
  • The information you provide is accurate and complete to the best of your knowledge

SafeNominee or an assigned professional may decline or stop a case where authority is unclear, where the information provided is materially wrong, or where continuing would be unlawful. You must not use a case to obtain access to an estate you have no entitlement to, or to obtain documents belonging to a living person without their consent.

6. Working Through the Platform

Cases, messages, documents and payments for a case are handled through SafeNominee so that there is a record of what was done. You and the assigned professional must not take a case sourced through SafeNominee off the platform in order to avoid platform fees, and must not solicit or make off-platform payment for on-platform work. Doing so may result in suspension, forfeiture of fees, and legal action.

7. Cancelling a Case

You may cancel a case at any time before any money has moved, and nothing will be charged. After the fee has been collected, cancellation is handled as a refund question under section 4 and the Financial & Refund Terms — whether a refund is due depends on how much work has already been carried out. SafeNominee may close a case where you cannot be contacted, where required documents are not provided, or where the work cannot lawfully proceed.

8. Data and Confidentiality

Documents and information you provide for a case are shared with the assigned professional, and with SafeNominee staff coordinating the case, only to the extent needed to carry out that work. They are handled under the SafeNominee Privacy Policy. Professionals are bound to keep case information confidential and to use it only for the case. Case records are retained as set out in the Privacy Policy and in accordance with applicable law.

9. Liability

Subject to section 2, and to the limitation of liability in the SafeNominee Terms of Service: • For cases carried out by an independent professional, Bitlooper LLP's liability relates to its operation of the platform — verification, coordination, and the correct handling and settlement of the money — and not to the professional services themselves. • For cases carried out by SafeNominee's own team, Bitlooper LLP is responsible as the provider of those services. • Nothing in these Terms excludes any liability that cannot be excluded under applicable Indian law, including under the Consumer Protection Act, 2019.

10. Changes to These Terms

These Terms may be updated. The version you accepted when you approved a case continues to govern that case; changes apply to cases approved after the change takes effect.

These Terms are governed by the laws of the Republic of India.
