Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Bitlooper ("we", "us") governing your access to and use of SafeNominee (the "Service"). By registering an account, accessing, or using the Service, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You have read, understood, and agree to these Terms and our Privacy Policy
• You are using the Service for lawful purposes only

If you do not agree to these Terms, you must not use SafeNominee.

2. Description of Service

SafeNominee is a digital legacy vault service that enables users to:

• Securely store encrypted personal and legal documents
• Designate nominees to receive access to specified documents
• Set inactivity-based triggers for nominee notification
• Manage subscription plans and billing

3. Important Disclaimer — SafeNominee Is NOT a Legal Will

SafeNominee does NOT:

• Create any legally enforceable rights of inheritance
• Replace a registered Will under the Indian Succession Act, 1925
• Guarantee property transfer to nominees
• Constitute a nomination under any insurance policy, provident fund, or bank account

SafeNominee is a document storage and communication tool. It helps ensure your nominees can access your stored documents — it does not determine who inherits your assets. Inheritance is governed exclusively by applicable succession laws, registered wills, and legal instruments. You are solely responsible for ensuring your legal estate planning is done through a qualified legal professional.

4. User Accounts and Security

4.1 Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the accuracy of your account information. False or misleading information may result in account termination.

4.2 Master Password Responsibility

Your documents are encrypted with AES-256. Your master password is stored securely on our servers and is required to decrypt and access your vault contents. You are responsible for keeping your master password confidential. If you forget or lose your master password, your ability to access your encrypted documents will be restricted. Bitlooper accepts no liability for loss of access to documents due to a forgotten or lost master password.

You must:

• Keep your master password in a secure location
• Inform your trusted nominees of how to obtain your master password if needed after your death
• Contact support at bitlooper.org@gmail.com if you need assistance with account recovery

4.3 Account Security

You are responsible for:

• Keeping your login credentials and master password confidential
• All activities that occur under your account
• Immediately notifying us of any unauthorised account access at bitlooper.org@gmail.com

We are not liable for losses arising from unauthorised access due to your failure to protect your credentials.

5. Subscription Plans and Payments

5.1 Plans

SafeNominee offers Free, Premium, and Premium Pro subscription tiers. Each plan has specific limits on document count, nominee count, storage capacity, and features. Plan details are displayed on the Plan Selection screen and may be updated by us with advance notice.

5.2 Billing and Renewal

Paid subscriptions are billed on the cycle you select (monthly, quarterly, half-yearly, or annually). Subscriptions renew automatically unless cancelled before the renewal date. You authorise Bitlooper to charge your payment method via Razorpay on the renewal date.

5.3 Refund Policy

Subscription fees are non-refundable except as required by applicable Indian consumer protection law. If you cancel a subscription mid-cycle, you retain access until the end of the paid period. No partial refunds are issued for unused subscription periods.

5.4 Claim Processing Fee

When a nominee submits a claim to access your vault documents after your death or incapacitation, a Claim Processing Fee applies based on your subscription plan:

• Free Plan: ₹3,500 (paid by the nominee)
• Premium Plan: ₹1,000 (paid by the nominee)
• Premium Pro Plan: No fee

This fee covers the manual verification, identity authentication, and administrative processing of the claim. The Claim Processing Fee is non-refundable once the claim verification process has commenced, regardless of the outcome.

5.5 Price Changes

We reserve the right to change subscription prices with 30 days' advance notice. Existing subscribers will be notified via email. Continued use after the effective date of a price change constitutes acceptance of the new pricing.

6. Nominee Management

You may designate one or more nominees who will be granted access to specified documents upon a triggering event (your death, incapacitation, or extended inactivity). By designating a nominee, you:

• Confirm you have the nominee's consent to store their personal information on SafeNominee
• Authorise SafeNominee to contact the nominee for claim verification purposes
• Acknowledge that we will provide the nominee only with the documents and access levels you have configured

6.1 Nominee Disputes

If multiple parties dispute the right to access your vault, Bitlooper:

• Will not adjudicate competing claims or interpret succession rights
• May suspend access to the contested vault pending a valid court order
• Will comply with court orders from competent Indian courts

Bitlooper is not liable for disputes between nominees, heirs, or legal representatives arising from or related to the use of SafeNominee.

7. Document Storage and Your Content

You retain ownership of all documents and content you upload to SafeNominee. You grant Bitlooper a limited, non-exclusive licence to store, process, and transmit your content solely to provide the Service.

You must not upload:

• Content that is illegal under Indian law
• Content that infringes the intellectual property rights of any third party
• Malware, viruses, or any harmful code
• Content that threatens, harasses, or exploits other individuals

We reserve the right to remove content that violates these Terms or applicable law without prior notice.

8. Prohibited Conduct

You agree not to:

• Attempt to reverse-engineer, decompile, or extract source code from SafeNominee
• Use automated tools to scrape, crawl, or access the Service beyond normal use
• Attempt to bypass authentication, encryption, or access control systems
• Use the Service to impersonate any person or entity
• Share your account credentials with any third party
• Use the Service in any manner that violates applicable Indian law

9. Intellectual Property

The SafeNominee application, branding, design, software, and related materials are the intellectual property of Bitlooper and are protected under Indian copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use Bitlooper's or SafeNominee's trademarks, logos, or brand names without express written permission.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• Bitlooper's total liability to you for any cause whatsoever shall not exceed the subscription fees paid by you to Bitlooper in the 12 months preceding the claim
• Bitlooper is not liable for: (a) any indirect, incidental, special, consequential, or punitive damages; (b) loss of access to documents due to a forgotten master password; (c) failure of nominees to claim documents within a specified time; (d) disputes between nominees or legal heirs; (e) force majeure events including server outages, natural disasters, or government actions; (f) your failure to maintain a registered legal Will or estate plan

The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bitlooper, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your content uploaded to SafeNominee
• Any dispute between you and your nominees or legal heirs
• Your failure to maintain your master password or account security

12. Service Availability and Modifications

We will make reasonable efforts to keep SafeNominee available 24/7. However, we do not guarantee uninterrupted service. We reserve the right to:

• Perform scheduled maintenance (with advance notice where practicable)
• Modify, suspend, or discontinue features with reasonable notice
• Discontinue the Service entirely with at least 90 days' notice, during which you may export your data

In the event of service discontinuation, we will provide data export functionality for a minimum of 90 days.

13. Account Termination

13.1 Termination by You

You may delete your account at any time from the Settings screen. Upon account deletion, your personal data will be purged within 30 days, except data we are required to retain for legal or compliance purposes.

13.2 Termination by Bitlooper

We may suspend or terminate your account with immediate effect if you:

• Violate these Terms or our Privacy Policy
• Use the Service for illegal purposes
• Engage in fraudulent activity
• Fail to pay subscription fees after 14 days' notice

Upon termination for cause, no subscription refund will be issued.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of India. Any dispute arising from these Terms or your use of SafeNominee shall be subject to the exclusive jurisdiction of the competent courts located in India.

14.1 Arbitration

Prior to initiating court proceedings, you agree to attempt good-faith resolution by contacting bitlooper.org@gmail.com. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual agreement. The seat of arbitration shall be India. The arbitration shall be conducted in English.

15. Consumer Grievances

In accordance with the Consumer Protection (E-Commerce) Rules, 2020:

If you are dissatisfied with our resolution, you may approach the National Consumer Disputes Redressal Commission (NCDRC) or the appropriate State Commission.

16. General Provisions

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Bitlooper regarding the Service
• Severability: If any provision is found invalid or unenforceable, the remaining provisions continue in full force
• Waiver: Failure to enforce any right under these Terms does not constitute a waiver of that right
• Assignment: You may not assign your rights under these Terms without our written consent
• Language: In the event of any conflict between translated versions of these Terms, the English version shall prevail
